Trump's "Dirty Water Rule" to be Revised

The Environmental Protection Agency (EPA) announced that it will revise regulations from the Trump administration that limit protections for certain bodies of water. The rule, commonly referred to as WOTUS, has been amended several times over various years. 

The EPA and the Army said in a statement that the rule “is leading to significant environmental degradation.” Acting Assistant Secretary of the Army for Civil Works Jaime Pinkham also said that current regulations established under the Trump administration have led to a drop of 25 percentage points in decisions that would give bodies of water protections under the Clean Water Act.

The Navigable Waters Protection Rule was established on April 21, 2020 after the Trump administration repealed an Obama-era rule that recognized smaller bodies of water as “waters of the United States” and gave them protections if they contributed to a larger water source. Protecting these small water sources was meant to prevent pollution from flowing into larger bodies of water, including drinking water resources. 

The Trump administration’s rule updated the definition of “waters of the United States” to exclude waters such as wetlands and streams from receiving protections under the Clean Water Act. 

The exclusion of certain bodies of water under the Navigable Waters Protection Rule is most significant in arid states like Arizona and New Mexico. Of the 1,500 streams in these two states, almost every one is excluded from protections. 
According to The Hill, EPA Administrator Michael Regan said that the agency will not “return verbatim” to the regulations from the Obama administration in a recent congressional hearing. 

A statement released by the EPA said that the new regulations will be guided by the Clean Water Act, the effects of climate change on water resources, the practicality of implementation, and input from the agricultural community, tribal and local governments, environmental groups, and communities with concerns about environmental justice. 

Our Take

We are very encouraged by the Biden administration and EPA’s step toward fixing water regulations. Water pollution can expose the public to harmful chemicals and substances through their drinking water, and we hope the new revisions to the Navigable Waters Protection Rule will recognize the importance of small bodies of water to the environment and our drinking water systems and protect them from pollution.

The leaking phosphogypsum waste pond that nearly collapsed recently in Florida once again shines a spotlight on the dangers and near-disasters posed by wastewater ponds throughout the country and their impacts on drinking water. These toxic waste ponds are not only created from phosphate mining, but used at power plants (coal ash) and large-scale agricultural facilities (such as manure from hog farming).  

PFAS Water Filters for Easton, Massachusetts

Recent testing requirements in the State of Massachusetts have forced local governments to take a closer look at the safety of their drinking water. These new requirements have revealed that Easton, Massachusetts, has elevated levels of PFAS in their tap water. This article will address what PFAS compounds are, the levels in Easton drinking water, and water filtration brands that actually remove them. 

PFAS in Easton, Massachusetts

The City of Easton, Massachusetts recently reported that PFAS are present in the city’s drinking water supply. State-level regulations of PFAS chemicals are relatively new, particularly in Massachusetts. Municipal water supplies were not required to even test for PFAS compounds until January 2021, when the state implemented these requirements. Up until that point, people in Easton and many other municipalities in Massachusetts did not know they were being exposed to this potentially cancer-causing chemical. 

In October, 2020, the Massachusetts Department of Environmental Protection set an enforceable standard of 20 parts per trillion for the sum of six PFAS compounds in drinking water. The six compounds, called PFAS6, are: PFOS, PFOA, PFHxS, PFNA, PFHpA, and PFDA. This regulation means that if a water sample exceeds 20 parts per trillion for all six compounds, that the municipal provider is in violation of the state law. What Are Per and Polyfluoroalkyl Substances?

Per and Polyfluoroalkyl Substances (PFAS) are a category of harmful compounds that can be found in drinking water sources across the country. PFAS can take hundreds of years to degrade in the environment which is why you may see them referred to as ‘forever chemicals.’ PFAS are not currently regulated at the federal level, but some states have created regulations or monitoring criteria, including Massachusetts. They are known to increase the risk of cancer, increase cholesterol, increase the risk of miscarriage by 80-120%, and several other negative health outcomes. According to the National Institute of Health, over 4,700 different PFAS variations have been used in some type of manufacturing since the 1950’s.

Is 20 ppt Safe?

There’s a bit of uncertainty around the “safe level” of exposure to PFAS compounds. There are only a handful of studies that assess associated health impacts, and most agree that more research is necessary to make a determination. In 2016, EPA set a non-enforceable Health Advisory Level of 70 parts per trillion for combined PFOA and PFOS. More recent data suggests that this level is far to high to provide meaningful protection against a range of negative health impacts. A recent study also found that a “safe level” or PFAS could be as low as 0.1 parts per trillion. Although the Massachusetts PFAS standard is on the lower end of state limits, our team would rather see even less PFAS allowed in municipal tap water. 

Not All Water Filters Remove PFAS

If you live in Easton and you’re looking for a solution, it’s important to understand that not all water filters are able to remove PFAS chemicals. Duke University completed a study in 2020 that tested various filtration brands and their ability to remove PFAS from drinking water. The results found that popular brands including Brita and Pur did not do a good job of removing PFAS compounds. Refrigerator filters tested by the Duke research team, including; Samsung, Whirlpool, and GE, also failed to remove PFAS. Problems We Found In Fresno's Drinking Water

We cross referenced these data with toxicity studies in scientific and medical literature. Where does Fresno Source its Drinking Water?

Fresno sources its drinking water from both groundwater and surface water sources. The city has 260 groundwater wells that draw water from the Fresno Sole Source Aquifer. Additionally, the city draws water from the Millerton and Pine Flat lakes which is delivered to the city via the Fresno Irrigation District canals.

Chromium 6 In Fresno’s Drinking Water

Fresno drinking water has some of the highest levels of Chromium 6 among major cities in the U.S. Chromium 6 is a highly toxic metal that is currently unregulated by the EPA. In the most recent Consumer Confidence Report, the city disclosed that the average concentration of Chromium 6 in drinking water was 2800 parts per trillion, and the highest level detected was 11,000 parts per trillion. For a bit of perspective, the California Water Boards previously set a public health goal of 20 parts per trillion for Chromium 6 in drinking water. Chromium 6 pollution is associated with metal processing, tannery facilities, chromate production, stainless steel welding, and pigment production. EPA has acknowledged that Chromium 6 is a known human carcinogen through inhalation, but is still determining its cancer potential through ingestion of drinking water. Lung, nasal and sinus cancers are associated with Chromium 6 exposure. Acute respiratory disease, cardiovascular, gastrointestinal, hematological, hepatic, renal, and neurological distress are health effects associated with high levels of chromium 6 exposure.

Synthetic Contaminants Found In Fresno's Drinking Water 

1,2 Dibromochloroporpane (DBCP) is a banned nematocide that was developed as a replacement for DDT. It was banned in 1979 but is still extremely persistent in the environment. In this years water quality report the average concentration detected in Fresno's water was 27 parts per trillion and the highest concentration detected was 170 parts per trillion. For a bit of perspective, this level is just under the regulatory limit of 200 parts per trillion. DBCP is an endocrine disruptor that specifically effects the male reproductive system. Additionally, several industrial solvents were detected in Fresno's drinking water. 1,2 Dichloroethylene, Tetrachloroethylene (PCE), and Trichloroethylene (TCE) were among some of the present contaminants. Little is known about their carcinogenic potential or other adverse health effects. Many of these contaminants are the result of industrial discharge, the byproduct of dry cleaning ingredients, or used in metal degreasing. 

Arsenic In Fresno’s Drinking Water

Arsenic is another carcinogenic heavy metal that was recently detected in Fresno’s drinking water. The 2017 Consumer Confidence Report disclosed that Fresno's water problems exceeded the California Public Health Goal of 0.004 parts per billion and was barely in compliance with the loose EPA Maximum Contaminant Level of 10 parts per billion. The highest level detected in Fresno’s water was 5.6 parts per billion and the overall average was 0.7 parts per billion. The Arsenic levels in Fresno were high enough that the city was required to make a statement in their report, notifying residents of the contamination. Arsenic is a toxic substance that is linked to a long list of health problems in humans, including various forms of cancer, and problems with the cardiovascular, immune, neurological and endocrine systems. Unlike several industrial chemicals, arsenic naturally occurs in bedrock. If you use a private well we highly recommend purchasing a filter to remove arsenic from your water.

It’s important to note that only a handful of contaminants are required to be included in annual Consumer Confidence Reports, and that there are hundreds of potentially harmful unregulated contaminants that aren’t accounted for. Volatile Organic Compounds (VOCs) In Drinking Water: What You Should Know

Most people are aware of Volatile Organic Chemicals (VOCs) because they are frequently discussed when selecting paint for their home, but many people don't realize that they can contaminate drinking water supplies. This article provides a broad overview of VOCs as it pertains to water, and also gives practical advice on how to protect against them if a water supply becomes contaminated.

What Are Volatile Organic Chemicals (VOCs)?

By definition, VOCs are a class of chemicals that vaporize easily at normal air temperatures. VOCs are commonly found in household and industrial products including gasoline, solvents, cleaners and degreasers, paints, inks and dyes, and pesticides. For example, gasoline is a mixture of VOCs including benzene, toluene, and other hydrocarbons, which gives gasoline it’s familiar odor.

Can VOCs Contaminate Drinking Water?

Absolutely. In fact, the US Geological Survey (USGS) found in a recent study that VOCs are present in one-fifth of the nation's water supplies. For example, benzene, (a constituent of gasoline) commonly enters groundwater when it spills or leaks out of underground fuel tanks. Other examples of commonly detected VOCs in drinking water include dichloromethane (methylene chloride), an industrial solvent; trichloroethylene, used in septic system cleaners; and tetrachloroethylene (perchloroethylene), used in the dry-cleaning industry.

How Are VOCs In Drinking Water Regulated By EPA?

Because It would be impractical and costly for municipalities to test for every potential chemical that can be categorized as a VOC, EPA regulates a subset of chemicals that commonly contaminate water supplies. For example, benzene, one rather common constituent, is regulated with a maximum contaminant level set at 0.005 milligrams per liter (parts per million) and a goal of zero in drinking water. Water analysis can be requested if there is reason to suspect the presence of a specific VOC.

Private wells are not covered by EPA's regulations and testing is typically optional. While VOCs can be detected by odor at high concentrations, laboratory analysis is the only way to measure VOCs in drinking water at the regulatory limits. We highly recommend that all people who get water from private wells get their water tested by an accredited laboratory.

How To Remove VOCs From Drinking Water

High quality water filters are the only effective way to remove Volatile Organic Compounds in water. These water filter companies (including Hydroviv) test their filters against chemicals that are selected to represent a wide range of VOCs that commonly contaminate water supplies. The NSF Standard 53 protocol for VOC reduction requires manufacturers to test against the chemicals listed in the table below:
